OLIVER WENDELL HOLMES, JR. ALS: "Oliver Wendell Holmes" as Associate Justice of the U.S. Supreme Court, 1p, 4¼x6. Boston, 1903 June 9. On letterhead of the Lenox hotel to unknown recipient. Begins: "Dear Sir". In full: "I am sorry to say that I have no autographs of my father to spare. It gives me pleasure to comply with your other slight request." OLIVER WENDELL HOLMES, JR. (1841-1935) penned this correspondence the year after President Theodore Roosevelt had appointed him as Associate Justice of the Supreme Court, where he would serve from 1902-1932. His father, OLIVER WENDELL HOLMES, SR. (1809-1894), a physician, educator and author, was famous for his witty and urbane poems, books and magazine articles. The younger Holmes inherited much of his father's personality and outlook on business and life, making him an unorthodox intellectual, which was reflected in his judicial decision-making. After graduation from Harvard in 1861, Holmes, who had been the class poet, served in the Civil War from 1861-1864 with the 20th Massachusetts Volunteers. He rose to the rank of Lieutenant Colonel and was wounded at the Battles of Balls Bluff (Virginia, 1861), Antietam (Maryland, 1862) and Fredericksburg (Virginia, 1862). Holmes began his law career in 1867 after graduating from Harvard Law School (1866). He had his own practice for 15 years before being appointed to the Massachusetts Supreme Court in 1882, where he served for 20 years (Chief Justice, 1899-1902). During his years on the U.S. Supreme Court, Holmes acquired the reputation as "the Great Dissenter", even though he was as brilliant and eloquent in his summaries for the majority opinion as for the minority. Holmes' "clear and present danger" decision in the Schenck vs. U.S. (1919) specified the only conditions under which freedom of speech can be impeded. Lightly creased with folds, vertical fold at the "v" in Oliver. Ink stains at lower right blank margin. Fine condition. Framed in the Gallery of History style: 39½x21½.
